Welcome to our website and thank you for your interest in our company. We take protection of your personal data very seriously. We process your data in accordance with the applicable laws regarding the protection of personal data, especially the EU General Data Protection Regulation (EU GDPR) and the country-specific implementation laws relevant to us. This data protection declaration provides you with comprehensive information on the processing of your personal data by DSD NOELL GmbH and your rights.  

Personal data means information that can be used to identify a natural person. Personal data includes especially includes your name, date of birth, address, telephone number, e-mail address but also your IP address.

Anonymous data is data that does not allow any reference to the data subject to be established.

Your rights as the data subject

To begin with, we would like to inform you at this point about your rights as the data subject. These rights are standardised in articles 15 - 22 EU GDPR. They cover the following:

  • Right to access (article 15 EU GDPR),
  • Right to erasure (article 17 EU GDPR),
  • Right to rectification (article 16 EU GDPR),
  • Right to data portability (article 20 EU GDPR),
  • Right to restriction of data processing (article 18 EU GDPR),
  • The right to object to data processing (article 21 EU GDPR).

Rights to object

Regarding the right to object, please note the following:

When we process your personal data for the purpose of direct advertising, you have the right to object to this data processing at any time without stating any reasons. This also applies to profiling if it is connected to direct advertising.

If you object to processing for the purpose of direct advertising, we will no longer process your personal data for this purpose. You can object free of charge in a formless message, preferably sent to: datenschutz@dsd-noell.com

If we process your data for safeguarding legitimate interests, you can object to this processing at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms or the processing serves towards establishing, exercising, or defending of legal claims.

Purpose of and legal basis for the data processing

In the processing of your personal data, the provisions of EU DS-GVO  as well as all other applicable data protection provisions are complied with. The legal basis for data processing is especially yielded from Art. 6 of the EU GDPR.

We use your data for generating business leads, fulfilling contractual and legal obligations, performance of the contract, offering products and services, and strengthening customer relationships.

Your consent also constitutes a permissibility requirement according to data protection law. Before granting the consent, we will inform you of the purpose of the data processing and your right to withdraw your consent.

Disclosure to third parties

We will only pass on your data to third parties within the scope of the legal provisions or with the corresponding consent. Otherwise, we will not pass on your data to third parties unless we are under a legal obligation to do so (disclosure to external bodies such as supervisory authorities or law enforcement authorities).

Data recipients of the data / categories of recipient

Within our company, we ensure that only those people who require your data to fulfil contractual and legal obligations receive your data.

In addition, our departments are supported by external service providers in fulfilment of their tasks. The contracts required in accordance with data protection laws have been signed with all service providers.

Transfer to third countries / intent to transfer to third countries

Transfer of data to third countries (outside the European Union and the European Economic Area) only takes place if this is required for performance of the contract, if it is prescribed by law, or if you have given us consent to do so.

Your personal data is transferred both to external service providers and to Group or affiliated companies in the group of companies, some of which are located outside the European Economic Area: None!

Data retention period

We store your data as long as it is required for the respective processing purpose. Please note that numerous data retention requirements necessitate further storage of data. This concerns in particular preservation duties under commercial law or tax law (e.g. German Commercial Code, Tax Code etc.) As long as no further retention obligations exist, the data is routinely deleted after the purpose has been fulfilled.

In addition, we will only store data if you have granted permission to us to do so or if information is required as evidence in legal disputes. Please also take into account statutory limitation periods, which can be up to 30 years; the normal limitation period is three years.

Secure transmission of your data

We take the appropriate technical and organisational safety measures for optimally protecting the data saved by us from accidental or deliberate manipulation, loss, destruction, or access by unauthorized persons. The security levels are continuously reviewed and adapted to new security standards in collaboration with security experts.

Data exchange from and to our website is performed using encryption. For our website, we offer the HTTPS transfer protocol using the respectively latest encryption protocols.  Moreover, the possibility to use alternative communication channels  (e. g. the postal route) exists..

Obligation to provide the data

Various personal data is necessary for the establishment, implementation and termination of the contractual relationship and the fulfilment of the associated contractual and legal obligations. The same applies to the use of our website and the various functions made available by this.

We have summarised details of this for you in the above-mentioned point. In certain cases data must also be collected resp. made available based on statutory provisions. Please note that a handling of your inquiry or the implementation of the underlying contractual relationship without providing this data is not possible.

We do not use purely automated processing processes for making decisions.
           
Server log files

Non-personal data such as e.g. browser type / version, operating system used, previously visited websites, the time of access and requested page are stored on the web server during each access to our website. Likewise, communication-related data, such as IP addresses or host name of the computer from where the page was retrieved are stored. This data is evaluated exclusively statistically and not matched with other personal data. A  classification to personal data does not take place.

For technical security reasons (in particular for the defence of attempted access to our web server) this data is stored in accordance with article 6 (1) lit. f EU GDPR. After no later than 7 days, an encryption through reduction of the IP address shall take place, so that no reference to the use is established.

Getting in contact

On our website you have the possibility to get in contact with us e.g. by means of use of the contact form. These require the entry of your personal data (name, telephone, e-mail, fax and contact partner. We collect, process and use your data exclusively for the purpose of handling your inquiry Your data will not be disclosed to third parties.

Use of cookies

In order to make your visit to our website attractive and to enable the use of certain functions, we use so-called "cookies" on various pages.. Cookies are small text files that your browser stores in your computer at the instruction of our website.. After the end of the browser session, most of the cookies used by us are deleted once again from your hard drive ("session cookies“). The so-called "permanent" cookies on the other hand remain on your computer and thus enable us to recognise you once again during your next visit Our partner companies are not permitted to collect, process or use personal data through cookies through our website. You have the possibility to prevent the storage of cookies on your computer through corresponding browser settings through which however the scope of the function of our offer may not be restricted.

Right to access

Your indicated data will be treated as confidential and used exclusively for getting in contact with you to the extent requested by you. Your personal data will not be used otherwise or disclosed to a third party. We attach great importance to the observance of data protection and the protection of your private sphere.

In addition, you have the right to rectification of incorrect data, blocking and erasure of your personal data, unless this conflicts with any statutory preservation obligation.
